Terms of Sales

All equipment/parts/materials are sold on an as/is, where/is basis, with no warranties or representations of any kind unless otherwise specified in writing by Envoy Equipment, LLC. All sales are final. Ownership will not change until payment in full is received and any third parties are paid. Should a warranty be offered to the customer it must be done so in writing on the invoice issued to the buyer and it will be offered through the manufacturer of the equipment, not through Envoy Equipment, LLC directly.

         Envoy Equipment, LLC does not offer credit terms. All purchases must be paid in full prior to shipping unless otherwise noted on the original invoice. Invoices can be paid with a company issued check, cashiers check, or direct wire. If paid by check, it may take up to 10 days for the payment to clear the bank and be available for transfer/collection. Equipment can not be released for sale until funds have fully cleared the banking process and are available for use in Envoy Equipment, LLC’s account.

         Buyer agrees to pay all applicable use and sales taxes as well as import/export duties and agrees for total liability of the same. Envoy Equipment, LLC is not responsible for collecting or distributing any federal, state, local, or foreign taxes or duties on behalf of the buyer or seller.

         All prices are stated in US Dollars and all payments must be received in US Dollars. Late payments are subject to a charge of 1.5% per month plus all costs of collection, including attorney fees.

         It is the responsibility of the buyer to properly install and properly use the equipment purchased from Envoy Equipment, LLC. We accept no liability for installation or misuse. When installation is part of this contract, any and all delays due to client scheduling will be at an additional cost to the client including increased labor and all expenses.

         Freight is not included in the sale unless otherwise specified on the original invoice. If freight is included in the sale, Envoy Equipment, LLC is not responsible in any way for damages that occur at any point during shipping. The buyer bears the burden of inspecting the shipment for damages upon arrival as well as filing a claim with the shipper directly if damage has occurred. Envoy Equipment, LLC is not responsible for shipping delays and is not liable for loss of revenue due to shipping delays or delayed installation for any reason.

         Payment of any invoice issued by Envoy Equipment, LLC constitutes agreement to the terms and conditions listed here.

         This agreement shall be interpreted in accordance with the laws of the State of Georgia. Any legal action to enforce the terms of this agreement shall be brought in Bartow County Superior Court, Cartersville, Georgia.
